Terms & Conditions

Security Deposit

The security deposit is due upon checking. Please keep in mind that you will need to venmo Rylee Vavra $250 in order to reserve this booking. The remainder will be due 72 hours before check in. The security deposit is 100% refundable as long as you do not cancel and you complete the check out list before departure. Check in is at 3:00PM and check out is 11:00AM. If you are adding a dog please make sure to send an email of a picture of your pet in order to get it approved. 

Consession Stand  

Concessions are available here at the Vavra Family Cabin. These include items like candy bars, boxed candy, chips, cookies, popcorn,  soda, caprisuns, sparkling cider, water, etc. These concessions are available at an extra charge to you as the guest. Prices are included in this   document as well as at the cabin located above the mini fridge. Please note that any items consumed, damaged, or misplaced during your stay will be debited from your security deposit.

For Example: If you buy 4 sodas ($1each) and 2 candy bars ($1each) a total of $6.00 will be debited from your security deposit refund. Therefore you will receive a total of $244.00 refunded  to you within 10 days of checkout. If the concession cabinet lock is broken you will forfeit your entire $250 security deposit.

Rental rate and fees are as stipulated in the fees and booking. 

SHORT TERM RENTAL AGREEMENT 

This Short Term Rental Agreement (the “Agreement”) is made by and between Aaron and Rylee Vavra (“Homeowner”) and you as the (“Guest”) as of the date last set forth on the conformation page of this Agreement.  For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 

Property.  The property is located at: 

1901 Pine Drive, Overgaard, Arizona 85933 

The property is furnished and includes Stove, Dishwasher, Microwave, Fridge, Plates, Bowls, Cups, Silverware, Cooking Utensils, Cleaning products, Linens, Towels, Blankets, Couches, Chairs, Fireplace, Beds, 2 Bathrooms, Toilet paper, Movies, Board Games, Lighter, Décor, Foosball Table, Ping Pong Table, Air hockey Table, Bumper Pool, Poker Table, Life Size Jenga. 5 bikes, Concession stand and more! 

Rental Party:  The rental party shall consist of Guest and the following persons: 

3.  Maximum Occupancy: The maximum number of guests is limited to 8 persons. An additional charge or $25 per person per night for guests in addition to 8 will be assessed (this includes small children/babies). 

4.  Term of the Lease.  The lease begins at 3:00 p.m. on the check in date and ends at 11:00 a.m. on the checkout date.

5.  Minimum Stay:  This property requires a 2 night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than 2 days, the guest will be charged the $300.00 nightly rate. 

6.  Rental Rules:  Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. 

7.  Access:  Guest shall allow Homeowner access to the property for purposes of repair and inspection.  Homeowner shall exercise this right of access in a reasonable manner. 

8.  Rental Rate and Fees 

Deposit:  A $250 deposit is required to book. This will be fully refunded to you within 10 days of check out as long as you follow all check out rules and there are no damages to the property.

The deposit is for security and shall be refunded within 10 days of the Checkout Date provided no deductions are made due to: 

damage to the property or furnishings; 

dirt or other mess requiring excessive cleaning;  

any liter left on the property; 

any cancelations of your reservation; 

any other cost incurred by Homeowner due to Guest’s stay. 

*If you cancel your reservation for any reason your deposit will NOT be refunded. 

Any items from the concessions consumed, damaged or misplaced will be debited from your security deposit refund. 

If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.  If the guests breaks or damages anything the Guest shall also inform the Homeowner Immediately. Not doing so can lead to your deposit not being refunded. 

All other fees will be disclosed to you and your reservation comformation will be emailed as well.

9.  Cancellation Policy:  If Guest wishes to cancel his/her reservation, the  deposit will not be refunded. Although if you cancel at least 7 days prior to arrival you will receive a refund on anything you have paid excluding the $250 deposit. 

Example: You decided to book for May 5th-7th. On April 22nd you paid the 50% upfront and then a family emergecy came up. As long as you cancel 7 days prior to your checkin date you will recieve all funds EXCEPT the security deposit back. Your security deposit is not refundable if there is a cancellation. 

10.  Insurance:  We encourage all renters to purchase traveler insurance. It is important to keep yourself insured in case anything were to happen during your stay.  

*Residential Landlord and Tenant Act is available on the Arizona department of housing's website. https://housing.az.gov (Ariz. Rev. Stat. § 33-1322) 

11.  Payment:  Acceptable payment methods are [made through VENMO or PAYPAL].  If you wish to pay with another payment method please contact the homeowners directly.

RENTAL RULES 

Smoking is NOT allowed.  

People other than those in the Guest party set forth above may not stay overnight in the property.  Any other person in the property is the sole responsibility of Guest.  Guests are not allowed to exceed the occupancy limit agreed to above. 

Guests should not create excessive noise at a level that disturbs neighbors; Code-enforced neighborhood quiet hours are from 10:00p.m. – 7:00a.m. 

All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 

Keep the property and all furnishings in good order 

Only use appliances for their intended uses 

PETS are permitted only with prior approval and the Pet Addendum must be completed.   

Parking: 

PARKING – Parking is limited to 4 vehicle(s).  Vehicles are to be parked in designated parking areas only.  Parking on the road is not permitted.  Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. 

Housekeeping:  There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the units. If any are missing upon departure you will forfeit your $250 security deposit. 

Garbage: Any garbage must be stowed in the proper garbage or recycling receptacle, located in the garage. You cannot leave any garbage either loose or in bags outside. You MUST put your trash in the designated trash pins located in the kitchen and garage.

Fireplace: The fireplace is a non-vented propane gas log fired firebox.  Please do not throw any paper or other combustible materials in the fireplace.]   [Fireplaces are turned off from May-September they are not operational during this time of the year as they are not needed.]  

Water and Septic: The cabin is on a septic system.  The mineral content in the water is high. The septic system is very effective; however, it will clog up if improper material is flushed.  DO NOT FLUSH anything other than toilet paper.  No feminine products should be flushed at anytime.  If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to $3,500.00.] 

Litter: Litter is NOT aloud on the property. If any trash is left outside it could cause harm to the wildlife in the area. Please always clean up messes and take food inside. Make sure ALL trash is thrown away or your deposit will be forfeited.  

Damaged item must be reported to the Homeowners IMMEDIATELY. Please contact Rylee at 480-268-5212. 

PET ADDENDUM 

*If you want to bring a pet you must add it on as a fee when checking out. THEN you must immediatly email a picture of your pet and some information about it for example, if your dog is potty trained, age, weight, is it friendly, etc to vavrafamilycabin@yahoo.com. Once we recieve the email we will have the opportuntity to approve your pet. IF your pet is approved we will keep the contract as is with the fee. If it is not approved we will remove the $25/night pet fee. Please note the approval of your pet is NOT contingent on this contract. If your pet is not approved you are still in a legal contract and if you cancel because you cannot bring your pet the $250 deposit is NON refundable. We do work with everyone to the best of our abilities to accomidate your fur friends. 

It is hereby agreed by and between Aaron and Rylee Vavra (Homeowner) and (Guest) that homeowner will allow guest to have the following described pet and no others in the vacation home upon and subject to the terms and conditions of the rental agreement and this addendum.  

 The permission granted herein shall be limited to a certain pet as described below:

 Guest hereby agrees to comply the following: 

1. Guest to pay additional pet fee in the amount of $25.00 per (night). 

2. All pets must comply with the following specifications (documentation from an accredited veterinarian must be provided by Guest upon request): a. May not exceed 95 lbs 

b. Must be at least 1 years or older. 

c. Must be spayed or neutered. (if not must get permission) 

d. Must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm preventive is highly recommended.  

3. All pets must be leashed at all times.   

4. Guest is responsible for cleaning up any/all pet refuse, if not your security deposit may be forfeited.  

5. Pets are not allowed on furniture at any time.  Any evidence of pets on furniture may incur extra cleaning fees debited from your deposit. 

6. All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival.  Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets.  

7. Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage may be charged to the guest. 

8. Guest should prevent pets from producing excessive noise at a level that disturbs neighbors. 

9. Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on patio or porch. If pet is left at the house it must be inside and in a locked Kennel. Pets are NOT allowed to roam the house or yard unattended.  

10. Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises.The Guest shall be solely responsible for the pet while on the property. 

Rules and Regulations:

1.) Quiet time is from 10:00pm-7:00am we do have neighbors so please be aware of your noise level. 

2.) If you use the fire pit outside during your stay make sure that the fire is put out with at LEAST 10 gallons of water. It needs to be drenched and then drenched some more.

3.) Feel free to read through the papers on the fridge with info on everything you need! 

4.) We are a litter free zone. PLEASE do not litter. It is bad for the wildlife. Please also never leave food outside. 

5.) If you have a pet with you they MUST be kenneled if you leave the property and outdoors they must be on a leash at all times. 

6.) Anytime you leave the cabin you need to make sure the front door, back door, and garage door are ALL locked. Windows must also be closed. 

7.) Any Concession items consumed, damaged or misplaced will be debited from your security deposit.

Check Out Procedure

Check out is at 11AM unless other arrangements have been made and your key code will expire at the time of checkout. If you are late you must contact the homeowners as your code will no longer work. 

1.) Please feel free to leave all the dirty towels/hand towels used during your stay on the ground in the bathrooms. Also please strip any beds that were used during your stay. You can put the sheets and pillow cases on the floor in the middle of the bedroom.Please keep comforters and pillows on the bed. Do NOT strip mattress topper.

2.) Please place all dirty dishes into the sink. 

3.) Please throw trash laying around the house into trash cans.

4.) Please make sure to clean out the fridge and cabinets. If there are any unopened items you are welcome to leave them. Anything that has been opened or is expired MUST be removed.

5.) Please contact Rylee at 480-268-5212 BEFORE checkout if anything has been damaged or broken.

6.) Please make sure to shut all windows, blinds, and make sure ALL doors are locked.

7.) Do a walk around the outside of the property and make sure there is no liter from your stay.

8.) Please leave the cabin neat and tidy like you found it. You do not need to wash anything but please make sure it is picked up. 

9.) Any furniture/decor moved NEEDS to be placed back where you found it. Including the pull out mattress and the coffee table.

10.) All space heaters and fireplace must be unplugged/turned off.

11.) Garage must be picked up. Games put away, Jenga re-set up, and all concession food/drink used put in the trash bins. Any dishes from eating/drinking must be taken to the kitchen.

Keys: 

Our cabin has electronic locks. You will recieve your code to enter the cabin within 24 hours before check in along with insturctions on how the locks work. You will also recieve the rules and regulations and the checkout procedurevia email prior to your stay.
